Waterfluence LLC (“We” or “Us” or “Our”) provides a website at www.waterfluence.com (“Website”) that permits authorized people (“Users”) to view water use information (“Information”) and receive landscape field surveys as part of our service (collectively the “Service”) The Information includes, in part, comparisons of historical water use to a budget benchmark based on site-specific characteristics and real-time weather.

The Service can help Users optimize landscape water use while maintaining a healthy landscape.

In order to most effectively provide the Service, We request that you (“You” or “Your”), as an authorized User, provide certain information to Us to use the Service. Any Information a User submits or receives using the Service will be subject to this Privacy Policy in addition to our Terms of Use.

1. Water Agency Customer Information

We collect water use information from our water agency clients or other third parties (collectively, “Agency(s)”) that have contracted for our Service and have sponsored Your participation in the Service. By participating in the Service, You understand that:

  • Per Your consent in the Term of Use, We will share Information we collect or generate through this Service with Your Agency and all additional contacts that authorize (e.g., HOA board members, landscape companies, property managers).
  • We can share Your Information with all future water customers at Your location (e.g., due to a change in ownership or tenancy).

2. Personal Information

We collect the following Information from all Users:

  • User contact information such as name, organization, e-mail address, and telephone number (collectively, “Profile”).
  • When You view and interact with the Website, we also collect Your IP address, browser type, and operating system to optimize our Service.
  • Through cookies and other technologies, we collect information that allows us to recognize and customize the User Website experience.

3. Uses of Information

We use the Information to:

  • Provide our Service.
  • Research and compare water use efficiency among sites.
  • Target and market financial incentive programs offered by Agencies.
  • Target and market free Landscape Field Surveys to qualified sites.

4. Your Obligations

You are responsible for controlling access to Your Information at all times.

5. Policy Updates

Notice of all changes that materially affect ways in which Your Profile may be used or shared will be posted in updates to our Privacy Policy and/or sent to the email address in Your Profile. The most recent version of the Policy will always be provided on the Website.

6. Security

Personal information You provide will be secured in accordance with industry standards and technology. Since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information You transmit to the Website. There is no guarantee that information may not be accessed, copied, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

7. Children Online Privacy Protection Act

In accordance with the Children’s Online Privacy Protection Act, We do not permit any children 13 years old or younger to register or submit any information via the Service. Any information obtained as a result of submission of false or misleading information from a child 13 years old or younger will be deleted following receipt of notice either directly or as a result of an email from the parent or adult guardian of such child that they have been registered in violation of Our Terms of Use.
