Waterfluence LLC (“We” or “Us” or “Our”) provides a copyrighted website at (“Website”) that permits authorized people (“Users”) to view water use information (“Information”) and receive services (collectively the “Service”). The Information includes, in part, comparisons of a landscape site's historical water use to a budget benchmark to improve irrigation efficiency.

Any Information a User submits or receives using the Service will be subject to this Privacy Policy in addition to our Terms of Use. This policy explains what kind of data we collect and how we may use and disclose it.

1. Information We Collect

(a) Water Service Provider. We may have a contract with your water utility / district / service provider (“Water Service Provider”) to provide us with your site’s historic water use data and customer data including account number, billing information, and location characteristics.

(b) Information You Provide Us. We collect User data such as name, email address, telephone number, and organization name. We collect site Information you may provide such as message board entries, maps, and water use information.

(c) Other Sources. We may collect information from third parties such as mapping services, or other publicly available sources such as county parcel records.

(d) Information Collected via Technology. When you visit our Website we collect information about your visit, including your browser type, operating system, Internet Protocol address, domain name, and the date and time of your visit via Cookies. Cookies are small pieces of information that a website sends to your viewing device.

2. How We Use Your Information

We use your Information to provide our Service. This includes to setup Your User account, to manage access of other Users to site Information, to update the Website’s content, to generate recommendations to improve water efficiency, to provide administrative notifications, to support our Services such as landscape field surveys, to enhance the performance of our Website, and to research irrigation efficiency.

You may have the option to designate additional users on our Website. Please give careful consideration to any such person before making this optional choice. Additional Users you designate will be able to view site Information which you can view.

If authorizing payments with a credit card, debit card, or bank account (ACH transaction), we do not store personal financial information such as credit card, debit card, or bank account numbers. Any financial information you enter will be collected by the payment processor and will be subject to the payment processor’s privacy policy, not ours.

3. Disclosure of Your Information

We do not share your Information without your permission. Exceptions to this general rule are below.

(a) Water Service Providers. We share your Information with your site’s Water Service Providers when they provide the water use data and/or sponsor a landscape field survey accepted at your site.

(b) Landscape Contractor Associations. We share your Information with landscape contractor associations (such as the California Landscape Contractor Association) where the contractor opts site into water management certification.

(c) Organization Members. We share site Information with all members of a User’s organization where at least one member of organization is granted permission to view site Information.

(d) Future Users. We share your Information with future Users at your site (e.g., due to a change in ownership or tenancy).

(e) Data Storage Providers. Site Information is stored in the hosting environments of cloud service providers with best practice security certifications we consider appropriate.

(f) Affiliates. Although we currently do not have a parent company, subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), we may in the future. We may share some or all of your Information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy.

4. Data Security

We implement reasonable measures designed to secure your Information against accidental loss, unauthorized access, use, alteration, and disclosure. These measures include access control, data encryption, and password controlled access to parts of our Website. You are responsible for keeping your password confidential. We ask you not to share your password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. No one can guarantee the security of your Information transmitted to our Website, including us. Any transmission of Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.
